Please read these Terms of Service carefully. By creating an account, accessing the platform, or using any feature of Your FSA Guide, you agree to be bound by these Terms. If you do not agree, do not use the platform.
1. About Your FSA Guide
Your FSA Guide ("Company", "we", "us", or "our") is an independent educational and guidance platform that helps individuals and employers better understand and utilize Flexible Spending Accounts (FSAs), Health Savings Accounts (HSAs), Over-the-Counter (OTC) benefit cards, and related healthcare spending benefits.
Your FSA Guide is operated by Gerson Sanchez, based in Boston, Massachusetts.
Your FSA Guide is NOT:
- A bank, financial institution, or depository
- An insurance provider or carrier
- A plan administrator or third-party administrator (TPA)
- A fiduciary under the Employee Retirement Income Security Act (ERISA)
- An agent of the IRS or any government body
We do not administer, hold, manage, process, or have any access to FSA or HSA funds at any time.
2. Acceptance of Terms
By accessing or using Your FSA Guide, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to these Terms of Service and our Privacy Policy.
If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. In such cases, "you" refers to that entity.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page and, for significant changes, by sending an email to registered users. Your continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
3. Account Registration and Security
- You must provide accurate, current, and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- You must notify us immediately at yourfsaguide@gmail.com if you suspect unauthorized access to your account.
- We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or provide false information.
- You may not share your account credentials with others or create accounts on behalf of others without their consent.
- Accounts created through Google or Microsoft OAuth are subject to the respective provider's terms in addition to ours.
4. Platform Services
4.1 Individual Services
Individual subscribers have access to AI-powered FSA and HSA guidance, balance tracking, deadline reminders, product recommendations, and the barcode scanner tool. Features vary by subscription tier (free, monthly, or annual).
4.2 Employer Services
Employer subscribers receive access to an HR Dashboard for managing employee invitations and monitoring FSA utilization metrics, bulk employee onboarding tools, and company-level reporting. Employer access is governed by our Licensing Policy, which is incorporated by reference into these Terms.
4.3 AI-Generated Content
All AI-generated guidance, recommendations, and responses are produced by artificial intelligence and are provided for informational purposes only. AI outputs may be inaccurate, incomplete, or outdated. You should verify all FSA and HSA eligibility determinations against your specific plan documents before making financial decisions. Your FSA Guide is not responsible for decisions made based on AI-generated content.
4.4 Barcode Scanner
The barcode scanner tool provides general FSA eligibility information for scanned products based on publicly available data. Eligibility determinations made by the scanner are informational only and may not reflect your specific plan's coverage rules. Always confirm with your plan administrator before purchasing.
5. Subscriptions, Billing, and Payments
5.1 Individual Plans
- Free plan: Limited access with 3 AI questions total and restricted feature access.
- Monthly plan ($15.99/mo): Full feature access, billed monthly, cancel anytime.
- Annual plan ($89.99/yr): Full feature access plus priority AI and advanced insights, billed annually.
- All paid plans automatically renew unless cancelled before the renewal date.
5.2 Employer Plans
- Essentials ($249/mo or $2,499/yr): Up to 25 employee licenses.
- Professional ($499/mo or $4,999/yr): 26–75 employee licenses.
- Enterprise Plus ($899/mo or $8,999/yr): 76–150 employee licenses.
- Enterprise: Custom pricing for 150+ employees. Terms governed by a separate written agreement.
- Founding Member pricing is locked for 3 years from initial subscription activation date.
5.3 Payment Processing
All payments are processed securely through Stripe. Your FSA Guide does not store credit card or payment information. By providing payment information, you authorize us to charge your payment method for the applicable subscription fees. All charges are in USD.
5.4 Refund Policy
Refunds are not issued for partial billing periods. Annual subscriptions cancelled mid-term are not eligible for prorated refunds unless a refund is expressly granted in writing by Your FSA Guide. If you believe you were charged in error, contact us within 30 days at yourfsaguide@gmail.com.
6. Acceptable Use
You agree not to use Your FSA Guide to:
- Violate any applicable federal, state, or local law or regulation.
- Submit false, misleading, or fraudulent information about your FSA or HSA balances.
- Attempt to gain unauthorized access to any part of the platform or another user's account.
- Use automated tools, bots, or scrapers to extract data from the platform without written permission.
- Reverse engineer, decompile, or attempt to extract the source code of the platform.
- Use the platform to provide financial, legal, or medical advice to third parties.
- Resell, sublicense, or redistribute access to the platform without prior written consent.
- Transmit viruses, malware, or any code designed to harm the platform or its users.
Violation of this section may result in immediate account termination without refund and, where applicable, legal action.
7. Intellectual Property
All content, features, functionality, design, trademarks, logos, and software on Your FSA Guide are the exclusive property of Your FSA Guide and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the platform for your personal or internal business purposes during the term of your subscription. This license does not include the right to copy, modify, distribute, sell, or create derivative works from any platform content.
Content you submit to the platform (health profile data, FSA balances, AI chat history) remains yours. You grant Your FSA Guide a limited license to use that content solely to provide and improve the services described in these Terms.
8. Disclaimers and Limitation of Liability
8.1 No Financial, Legal, or Medical Advice
Your FSA Guide provides educational information only. Nothing on the platform constitutes financial, tax, legal, or medical advice. Always consult a qualified professional for advice specific to your situation.
8.2 Disclaimer of Warranties
The platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or timeliness of any information provided.
8.3 Limitation of Liability
To the fullest extent permitted by law, Your FSA Guide shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including but not limited to loss of FSA funds, missed deadlines, or reliance on AI-generated guidance. Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
9. Employer-Specific Terms
Employers subscribing to a company plan agree to the following additional terms:
- You are responsible for ensuring your use of the platform complies with applicable employment laws, including ERISA, HIPAA, and state-level benefits regulations.
- You will not use the HR Dashboard to collect, store, or process employee health information beyond what is necessary to facilitate FSA guidance.
- You will promptly revoke access for any employee who leaves your organization. You are liable for any unauthorized access resulting from failure to do so.
- Aggregated utilization data provided in the HR Dashboard does not contain individual employee health information.
- You represent that you have obtained any necessary employee consent for using Your FSA Guide as part of your benefits offering.
- Your FSA Guide does not assume any employer obligations under ERISA, ACA, or other benefits regulations by virtue of providing this platform.
10. Termination
Either party may terminate this agreement at any time. You may cancel your subscription through your account settings or by contacting us at yourfsaguide@gmail.com.
- Upon termination, your access to the platform will cease at the end of the current billing period.
- We reserve the right to terminate or suspend your account immediately if you violate these Terms.
- Upon account deletion, your personal data will be retained for 30 days before permanent deletion, in accordance with our Privacy Policy.
- Sections 1, 7, 8, 11, and 12 of these Terms survive termination.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or your use of the platform shall first be submitted to informal negotiation for 30 days. If unresolved, disputes shall be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, with proceedings held in Boston, Massachusetts.
You waive any right to participate in a class action lawsuit or class-wide arbitration against Your FSA Guide.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
12. General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy and Licensing Policy, constitute the entire agreement between you and Your FSA Guide.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
- Waiver: Failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
- Assignment: You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights freely.
- Notices: All legal notices to Your FSA Guide should be sent to yourfsaguide@gmail.com.
- Force Majeure: We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control.
